These Terms and Conditions (“Terms”) constitute a legally binding agreement between the (“Customer,” “you”) and Revive Cans Inc., operating as We Clean Garbage Cans (“Company,” “we,” “us”), governing your use of our website at wecleangarbagecans.ca and any services purchased through it.
By accessing our website, submitting a service request, or completing a purchase through our checkout process, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the website or purchase our services.
1. Description of Services
We Clean Garbage Cans provides curbside garbage can cleaning services in the Waterloo Region of Ontario, Canada. The specific scope, frequency, and pricing of the service you receive are described on our website and confirmed at the time of purchase. We reserve the right to modify our service offerings at any time.
2. Eligibility
You must be at least 18 years of age and capable of forming a legally binding agreement to use our services. By completing a purchase, you represent that all information you provide is accurate, current, and complete.
3. Recurring Billing and Payment
Some of our services are offered on a recurring monthly basis. By signing up, you authorize us to charge your selected payment method on a recurring basis at the interval and amount confirmed at checkout, until you cancel.
Your credit or debit card is required at signup but is not charged until the time of service. You will be charged on an ongoing basis upon completion of each service on your scheduled day, according to the frequency you have selected.
All payments are processed through Stripe, a third-party payment processor. We do not store your credit or debit card information on our systems. Your use of Stripe is subject to Stripe’s own terms and privacy policy, available at stripe.com/privacy.
You are responsible for keeping your payment information current. If a payment fails, we may suspend service until the outstanding balance is resolved.
4. Cancellation
You may cancel your service at any time by contacting us at hello@wecleangarbagecans.ca or by calling 226-338-3870. To avoid being charged for your next scheduled cleaning, your cancellation must be received at least 4 days before your next billing date.
We reserve the right to cancel or suspend your service at any time, with or without notice, if we determine in our sole discretion that continued service is not feasible or that these Terms have been violated.
We reserve the right to issue refunds at our discretion.
5. Customer Responsibilities
You are responsible for ensuring your garbage cans are placed at the curb and are accessible on your scheduled collection day. We are not obligated to reschedule or provide a credit if your garbage cans are not accessible at the time of service.
You are reponsible for notifying us if you wish to skip, cancel, or pause your service.
6. Service Interruptions
Service may be delayed or rescheduled due to weather, equipment issues, or other circumstances beyond our control. In the event of a missed cleaning caused by us, we will make reasonable efforts to reschedule and will notify you accordingly.
We are not liable for any damages, losses, or inconvenience arising from service delays or interruptions.
7. Limitation of Liability
To the fullest extent permitted by applicable law, We Clean Garbage Cans, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services or website, regardless of the cause of action or theory of liability.
Our total aggregate liability to you for any and all claims arising out of or related to these Terms or the services shall not exceed the total amount paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.
8. Intellectual Property
All content on the wecleangarbagecans.ca website, including text, graphics, logos, images, and design, is the property of Revive Cans Inc. and is protected under applicable Canadian intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
9. Indemnification
You agree to indemnify, defend, and hold harmless Revive Cans Inc. and its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your use of our services, or any violation of applicable law.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
11. Privacy
Your use of our services is also governed by our Privacy Policy, available at wecleangarbagecans.ca/privacy. By agreeing to these Terms, you also acknowledge that you have read and understood the Privacy Policy.
12. Modifications to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Revive Cans Inc. with respect to your use of the website and services, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
